Cancellation and Termination Policy

Effective from 16th June 2021. Effective to now.

Cancellation

You have a legal right to change your mind about making a purchase from us within 14 days and receive a refund.  These rights, under the Consumer Contracts Regulations 2013, are as follows:

  1. In relation to services: You have 14 days after the day we email you to confirm your order. However, once we have completed the services you cannot change your mind, even if the period is still running. If you cancel after we have started the services (for example if we have already written or partially written a 12 week training plan or you have already attended an in-person assessment or completed a remote assessment and submitted your data), you must pay us for the services provided up until the time you tell us that you have changed your mind.
  2. In relation to goods: You have 14 days after the day you (or someone you nominate) receives the goods. Please see our Returns Policy for further information.

In addition, we give a goodwill guarantee in respect of services booked in advance, namely a Skype Consultation or an in person Lattice Board Assessment with a Lattice in-house trainer (“LBA”). This is more generous than your legal rights under the Consumer Contracts Regulations, in the ways set out below. This goodwill guarantee does not affect your legal rights in relation to faulty or misdescribed goods and services:

  • If you cancel with at least 21 days’ notice of the agreed date for the Skype Consultation or LBA, we’ll offer a full refund;
  • If you cancel with between 7 and 21 days’ notice of the agreed date for the Skype Consultation or LBA, we’ll offer a 75% refund; and
  • If you cancel with less than 7 days’ notice of the agreed date for the Skype Consultation or LBA (but 24 hours before the assessment is booked to take place), we’ll offer a 50% refund.

Cancellation policies at Partner Walls may vary and you are responsible for checking these.

Termination of Premium Subscription

Our Performance Plan subscription requires an upfront payment of a deposit to reserve your place plus payment to cover an assessment that you will undertake in your first 4 weeks of training (unless you’ve already completed a Lattice assessment in the previous 6 months). You are then committed to make 6 further monthly payments starting on the Monday of your first training plan, in return for which you will receive: an initial 4 week training plan which includes an assessment (unless you’ve already completed a Lattice assessment in the previous 6 months) (“Discovery Phase”), an 8 week training plan, and then a subsequent 12 week training plan. 

If you need to take a break from training during the first 6 months training with us your subscription payments must still continue uninterrupted until the expiry of the 6 month minimum term. Your subscription will then renew automatically (unless you let us know that you wish to terminate by giving the notice specified below) and you will receive further 12 week training plans which require 3 monthly subscription payments per plan.

A Performance Plan subscription can only be terminated by giving us at least 6 weeks’ notice by email to [email protected].  A notice will only take effect after the final subscription payment if given in the initial 6 months of subscription and then after the third subscription payment in respect of the current 12 week training plan.

If you do not provide at least 6 weeks’ notice of cancellation, the deposit that you pay at the beginning of your subscription will be forfeited and we may use it to cover the losses that we incur as a result. If you provide 6 weeks’ notice, we will cancel your recurring payment 1 month early and use your deposit payment to cover the cost of the final month.

If you place an order for a Performance Plan subscription and you cancel after being assigned a Lattice coach by email but before receiving your first training plan, your deposit will be forfeited and we may use it to cover the losses that we incur as a result. 

If we make a variation to your agreement which is likely (in our reasonable opinion) to be of material detriment to you (as explained in our Terms of Service under Prices & changes to these terms) you will be able to cancel this agreement without penalty in line with the terms we set out in our notification of variation which we will send by email. Please note that if the variation is due:

(i) to changes to the law, government regulation or any licence which affect us – this includes any increase or change in the rate of VAT or other applicable taxes or fees or any new taxes or fees that are introduced; or

(ii) the change isn’t (in our reasonable opinion) likely to be of material detriment to you;

then you will only be able to cancel your agreement in accordance with the terms of our standard Cancellation Policy as set out above.

We may terminate or (at our option) suspend the provision of our services if we do not receive from you any payment that is due to us. We may also terminate the provision of our services if in our reasonable opinion you do not meet the minimum requirements for the training plan service you have purchased.

Termination of Flexibility Plan Subscription

Our Flexibility Plan subscriptions require an upfront payment of a deposit equivalent to one month of subscription payment to reserve your place plus a commitment of 3 monthly payments starting on the first Monday of your flexibility plan, in return for which you will receive one 12 week flexibility plan plus an assessment report. Your subscription will then renew automatically (unless you let us know that you wish to terminate by giving the notice specified below) and you will receive further 12 week flexibility plans which require 3 monthly subscription payments per plan.

If you need to take a break from training during your plan, your subscription payments must still continue uninterrupted until the expiry of your current flexibility plan.

A Flexibility Plan subscription can only be terminated by giving us at least 6 weeks’ notice by email to [email protected].  A notice will only take effect after the third subscription payment if given in the initial 3 months of subscription and then after the third subscription payment in respect of the current 12 week flexibility plan.

If you do not provide at least 6 weeks’ notice of cancellation, the deposit that you pay at the beginning of your subscription will be forfeited and we may use it to cover the losses that we incur as a result. If you provide 6 weeks’ notice, we will cancel your recurring payment 1 month early and use your deposit payment to cover the cost of the final month.

If you place an order for a flexibility plan subscription and you cancel after being assigned a Lattice coach by email but before receiving your first flexibility plan, your deposit will be forfeited and we may use it to cover the losses that we incur as a result. 

If we make a variation to your agreement which is likely (in our reasonable opinion) to be of material detriment to you (as explained in our Terms of Service under Prices & Changes to these Terms) you will be able to cancel this agreement without penalty in line with the terms we set out in our notification of variation which we will send by email. Please note that if the variation is due:

(i) to changes to the law, government regulation or any licence which affect us – this includes any increase or change in the rate of VAT or other applicable taxes or fees or any new taxes or fees that are introduced; or

Termination of Nutrition Subscription

Our Nutrition Plan subscriptions require a deposit to reserve your place plus a commitment of 3 monthly payments in return for which you will receive one 12 week nutrition plan. Your subscription will then renew automatically (unless you let us know that you wish to terminate by giving the notice specified below) and you will receive further 12 week nutrition plans which require 3 monthly subscription payments per plan.

A Nutrition Plan subscription can only be terminated by giving us at least six weeks’ notice by email to [email protected].  A notice will only take effect after the third subscription payment if given in the initial 3 months of subscription and then after the third subscription payment in respect of the current 12 week nutrition plan.

If you do not provide at least 6 weeks’ notice of cancellation, the deposit that you pay at the beginning of your subscription will be forfeited and we may use it to cover the losses that we incur as a result.

If you provide 6 weeks’ notice, we will cancel your recurring payment 1 month early and use your deposit payment to cover the cost of the final month.

If you place an order for a Nutrition Plan subscription and you cancel after receiving a Nutrition Report but before receiving your first nutrition plan, your deposit will be forfeited and we may use it to cover the losses that we incur as a result.

Please note that unlike our Premium Subscription, there is no option to pause our Nutrition Plan subscription.

Termination of Lattice 365 Subscription

Either of us may cancel your participation in Lattice 365 at any time by either notifying the other in writing by email (please email [email protected]com if you wish to cancel) or by cancelling your subscription via your account on latticetraining.com.
